Abstract: Even if it did not provide a definition of the statutory maintenance obligation, the legislator did regulate this institution in detail. Careful regulation of the legal maintenance obligation did not lead to the avoidance of divergent interpretations in judicial practice, with courts facing a wide range of situations that could not be foreseen by the legislator. This study aims to analyze the legal provisions governing the maintenance obligation and how they have been interpreted and applied by the courts, highlighting the issues currently controversial.
